DePaul's Definition of Sexual Assault

Sexual Assault: is as an act of sexual penetration (oral, anal, or vaginal) with the use or threat of force or an act of sexual penetration when the accused knew that the victim was "unable to understand the nature of the act or was unable to give knowing consent."

In the state of Illinois, if an individual is “incapacitated from drugs or alcohol” (i.e. drunk) they cannot give consent to having sex. Having sex with someone who is drunk, is by definition, sexual assault/rape.

This is the definition of Sexual Assault that is taught at DePaul to first year students in the Common Hour program.
